No compensation, by design

Nothing of value, to anyone, ever

Federal law (18 U.S.C. § 215) bars giving anything of value to bank and credit-union employees for referrals, so we never offer it: no fee, no gift, no payout.

  • Not to you, not to your colleagues, and not to your institution either: we're stricter than the law requires.
  • It covers everyone acting for your institution: officers, employees, agents and outside counsel.
  • No meals, tickets or holiday gifts in exchange for introductions.
  • It's written into the Bank Referral Agreement you accept at sign-up.

Check with your compliance team before you start. Share customer information only with the customer's permission and as your institution's privacy policy allows. We're glad to walk your compliance officer through how this works.

1. Who this is between

This agreement is between Capco Capital LLC ("Capco Capital", "we") and the bank or credit union named in your sign-up ("your institution"), accepted on its behalf by you, the officer named there. Capco Capital LLC is a commercial lending advisor. We are not a lender, and we are not affiliated with your institution.

2. No compensation, ever

We never pay, offer or give anything of value to you, to any other officer or employee, or to your institution for an introduction: no referral fee, commission, bonus, gift, meal or entertainment, and nothing offered in exchange for referrals (18 U.S.C. § 215; for credit unions, 12 CFR 701.21(c)(8); and state law, such as La. R.S. 6:417). There is no fee schedule, no tax form and no payout, and your portal shows none.

3. What you do

When a business customer's request doesn't fit your institution, you may give them our information, or, with the customer's permission, send us their name and contact details. Share customer information only with the customer's agreement and as your institution's privacy policy allows. This introduction doesn't replace any notice your institution must give the customer about its own credit decision. You don't negotiate terms, quote rates or promise anyone an approval.

4. Your customer stays your customer

We arrange business financing through our lender network. We don't offer deposit accounts, treasury or payment services, and we never encourage a customer you introduced to move their deposit or treasury relationship away from your institution. When they're ready for bank financing again, we point them back to their own bank.

5. Where we work

We arrange financing nationwide except California. Please don't send us California businesses.

6. Your portal

Your portal shows the businesses your institution introduced and where each one stands: the stage, the deal size and, on real-estate deals, the property address. The borrower's financials, documents, credit and lender details stay private between them and us. Keep what you see confidential, and keep your sign-in to yourself.

7. Your institution's policies

You confirm you're authorized to make introductions for your institution and that you follow its policies on referrals, customer information and co-branded materials. Use your institution's name on our customer handout only where your institution allows it.

8. Ending it

Either side can end this agreement at any time by telling the other in writing.

Van reviews every sign-up personally. Once it's approved, you'll get an email with your portal sign-in. No cost, and no fee, by design.

Questions

Straight answers

Is this a referral fee arrangement?

No. Nobody at your bank or credit union receives anything of value for an introduction, and the Bank Referral Agreement says so in writing. Federal law (18 U.S.C. § 215) bars it, and we wouldn't offer it anyway.

Does this replace our adverse-action notice?

No. Keep your normal process, including any notice your institution gives about its own credit decision. The introduction happens alongside it, never instead of it.

Will you solicit our deposits or treasury business?

Never. We don't offer deposit, treasury or payment services, and we never encourage a customer you introduced to move them. When they're ready for bank financing again, we point them back to you.

What do you need from us?

Just the introduction, with the customer's permission. A name and a phone number or email is plenty. We take it from there and keep you posted in your portal.

Who signs up: me or the bank?

The institution. You sign up with your bank or credit union's name, your name and your title, and accept the Bank Referral Agreement on its behalf. Colleagues can be added later.
